NOTICE OF BOND RELEASE

In accordance with KRS 350.093, notice is hereby
given that Nally & Hamilton Enterprises, Inc., P.O.
Box 157, Bardstown, Kentucky 40004 has applied
for a Phase II and III Bond Release on increments 1, 4, and 5 and a Phase III Bond Release
on Increments 2, 3, 6, 7, and 10 of permit no. 848-
0206 which was last issued January 26, 2015.
Increment no. 1 covers an area of approximately
116.50 acres of surface area and underlies an
additional 88.39 acres of underground area. Increment no. 2 covers an area of approximately 108.48
acres of surface area and underlies an additional
70.93 acres of auger area. Increment no. 3 covers
an area of approximately 81.98 acres of surface
area and underlies an additional 30.29 acres of
auger area. Increment no. 4 covers an area of approximately 7.77 acres of surface area. Increment
no. 5 covers an area of approximately 9.06 acres
of surface area. Increment no. 6 covers an area
of approximately 127.91 acres of surface area
and underlies an additional 52.68 acres of auger
area. Increment no. 7 covers an area of approximately 84.53 acres of surface area and underlies
an additional 169.34 acres of underground area.
Increment no. 10 covers an area of approximately
18.74 acres of surface area.

The permit area is located approximately 0.88
miles Southwest from Lewis
Creek Road’s junction with U.S. 119 and located
in Coldiron Branch, Lewis Creek and Wilson Fork.
The permit area is also located approximately 1.00
mile south of Partridge in Harlan and Letcher
Counties.

The bond now in effect for Increment 1 is a surety
bond in the amount of $134,000.00 of which 100%
of the original bond amount of $361,200.00 is to
be included in this application for release. The
bond now in effect for Increment 2 is a surety bond
in the amount of $49,200.00 of which 100% of
the original bond amount of $993,200.00 is to be
included in this application for release. The bond
now in effect for Increment 3 is a surety bond in
the amount of $36,200.00 of which 100% of the
original bond amount of $597,000.00 is to be
included in this application for release. The bond

now in effect for Increment no. 4 is a surety bond
in the amount of $12,000.00 of which 100 % of the
original total bond amount of $22,300.00 is to be
included in this application for release. The bond
now in effect for Increment no. 5 is a surety bond
in the amount of $13,800.00 of which 100 % of the
original total bond amount of $26,900.00 is to be
included in this application for release. The bond
now in effect for Increment no. 6 is a surety bond
in the amount of $62,100.00 of which 100 % of the
original total bond amount of $369,500.00 is to be
included in this application for release. The bond
now in effect for Increment no. 7 is a surety bond
in the amount of $36,000.00 of which 100 % of the
original total bond amount of $257,500.00 is to be
included in this application for release. The bond
now in effect for Increment no. 10 is a surety bond
in the amount of $8,300.00 of which 100 % of the
original total bond amount of $54,000.00 is to be
included in this application for release.

Reclamation work performed included: All mining
area was backfilled and graded with all highwalls
eliminated and the area was seeded, this work
was completed in spring of 2011.

Written comments, objection and request for a
public hearing or informal conference must be
filed with the Director, Division of Field Services,
300 Sower Blvd., Frankfort, Kentucky 40601 by
Friday August 24, 2018.

A public hearing on the application has been
scheduled for Monday, August 27, 2018 at 10:00
a.m., at the Department for Natural Resources,
Middlesboro Regional Office, 1804 East Cumberland Avenue, Middlesboro Kentucky 40965-1229.
This Hearing will be canceled if no request for a
hearing or informal conference is received by
Friday August 24, 2018.

NOTICE OF INTENTION
TO MINE

Pursuant to Application Number 867-0534,
Transfer

In accordance with 405 KAR 8:010, notice is
hereby given that Deane Mining, LLC, P.O. Box
1169, Pikeville, KY 41502, intends to transfer
permit number 867-0474 to Deane Mining, LLC,
PO Box 71, Deane, KY 41812. The new permit
number will be 867-0534. The operation disturbs
a total of 508.6 acres. No new acreage is affected
by the transfer.

in Letcher County. The operation is approximately
0.50 miles northeast from KY 317’s junction with

Branch of Rockhouse Creek. The operation is
located on the Kite, Jenkins West, Mayking, and
Wheelwright U.S.G.S. 7 1/2 minute quadrangle
map.

The application has been filed for public inspection
at the Department of Natural Resources Pikeville
Regional Office, 121 Mays Branch Road, Pikeville,
Kentucky 41501. Written comments or objections
must be filed with the Director, Division of Permits,
300 Sower Blvd, Frankfort, Kentucky 40601.

NOTICE OF INTENTION
TO MINE

Pursuant to Application Number 867-5313
Renewal

In accordance with KRS 350.055, notice is hereby
given that Sapphire Coal Company, 1073 Riverview Street, Grundy, VA 24614, has applied for
renewal permit for an existing underground coal
mining and reclamation operation located 1.25
miles east of Premium in Letcher County, Kentucky. The renewal disturbs 14.12 surface acres
and underlies 517.35 acres, making the total area
within the permit boundary 531.47 acres.

The renewal application is approximately 1.90
miles east from KY 588’s junction with KY 160
and located on the North Fork of the Kentucky
River. The renewal application is located on the
Blackey and Roxana U.S.G.S. 7 ½ minute quadrangle maps.

The surface area to be affected by this renewal is
owned by Kentucky River Coal Corporation. The
operation will underlie land owned by Kentucky
River Coal Corporation.

The application has been filed for public inspection
at the Department for Surface Mining Reclamation
and Enforcement’s, Pikeville Regional Office, 121
Mays Branch Road, Pikeville, Kentucky 41501..
